1. Agreement to Terms

By accessing or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our Services. These terms apply to all visitors, users, and others who access or use our website and mobile applications.

2. Description of Services

Mone Apps provides mobile applications and web services for health, well-being and everyday productivity. Our Services may include:

• UV index, sun-safety and tanning guidance
• Nutrition scanning and tracking
• Habit-change and well-being companions
• Other features as described in the relevant application

3. User Accounts

When you create an account, you must provide accurate, complete and current information. You are responsible for safeguarding your account credentials and for activities taken under your account. Notify us immediately of any unauthorized access. We are not liable for losses arising from your failure to comply with this section.

4. Acceptable Use

You agree not to use the Services to:

• Violate any applicable laws or regulations.
• Infringe the rights of others, including intellectual property rights.
• Upload or share content that is illegal, harmful, threatening, abusive, or otherwise objectionable.
• Generate or distribute misleading or deceptive content, including deepfakes intended to deceive.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with or disrupt our Services or servers.
• Use the Services for commercial purposes without our prior written consent.
• Reverse engineer, decompile, or disassemble our software.

5. User Content

You retain ownership of content you submit through our Services. By submitting content, you grant Mone Apps a worldwide, non-exclusive, royalty-free license to use, process and display such content solely for the purpose of providing the Services to you. You are responsible for the content you submit and represent that you have all necessary rights.

6. AI-Generated Content

Some Services use artificial intelligence to generate or modify content. You acknowledge that AI outputs may be inaccurate or unsuitable for your specific purposes, that you are responsible for reviewing AI-generated content before relying on it, that we do not guarantee its accuracy or reliability, and that you are responsible for ensuring its use complies with applicable laws.

7. Subscriptions and Payments

Some features require a paid auto-renewable subscription billed through your Apple ID. Price and length of each subscription are displayed in the app at the point of purchase. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your App Store account settings. Refunds are subject to the policies of the applicable app store.

8. Intellectual Property

The Services and their original content (excluding user content), features and functionality are and will remain the exclusive property of Mone Apps and its licensors and are protected by copyright, trademark and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

9. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will immediately cease.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, secure or error-free, or that defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall Mone Apps, its directors, employees, partners, agents, suppliers or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, use or goodwill, arising from your access to or use of (or inability to access or use) the Services.

12. Indemnification

You agree to defend, indemnify and hold harmless Mone Apps and its officers, directors, employees and agents from any claims, damages, obligations, losses, liabilities and expenses arising from your use of the Services or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict of law provisions. Failure to enforce any right or provision will not be considered a waiver of that right.

14. Changes to Terms

We may modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice before it takes effect. Continuing to use the Services after a revision becomes effective constitutes acceptance of the revised Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in effect.
